Market Type
In North Dakota, cannabis sales are regulated by the Department of Health and Human Services. Only qualifying medical patients are permitted to purchase cannabis in North Dakota.
BioTrack and Inventory
North Dakota leverages BioTrack as its statewide seed-to-sale system. Additionally, patient dispensation records are managed in the state’s Prescription Management Program (PMP).
Purchase Limits
- Qualifying patients are initially permitted to purchase against the standard limit of 2.5 Oz (70.87g) of Dry Flower per 30 day period.
- Specific qualifying patients may apply for an enhanced allowable limit, which permits the purchase of up to 6 Oz (170.01g) of Dry flower per 30 day period.
- Medical patients may purchase up to 6,000 mg of THC in the form of cannabinoid concentrates or medical cannabinoid products per 30 day period.
- Minor patients in North Dakota (and their caregivers) may only purchase Pediatric Medical Marijuana, which may not contain a concentration of more than 6% THC.
Taxes
North Dakota has not adopted any cannabis specific tax rules.
Delivery
In North Dakota, cannabis delivery is permitted, and must be accompanied by a manifest completed on a form approved by the department.

As of August 1, 2023, North Dakota increased the non-flower THC purchase limit (concentrates, solutions, capsules, transdermals, and topicals) to 6,000 mg per 30 day period.
