Market Type

In Mississippi, cannabis is regulated by multiple agencies. The Mississippi Department of Health, through the Mississippi Medical Cannabis Program (MMCP), regulates most of the industry, while dispensaries are overseen by the Department of Revenue. The Mississippi Board of Pharmacy operates the Prescription Monitoring Program (PMP).

Tracking & Inventory

Mississippi uses a combination of Metrc and the PMP. Sales are recorded in Metrc, which also tracks inventory and provides the patient allotment lookup. The PMP is a patient-lookup and dispensing-reporting system operated by the Board of Pharmacy; it is not the system of record for sales transactions.

Cardholder limit
  • A cardholder may not receive more than 24 MMCEUs in a rolling 30 days.
  • Non-resident cardholders may obtain 12 MMCEUs per 15-day period (two 15-day periods per year).

Metrc tracks the monthly allotment values. A Metrc allotment check must be performed before dispensation.

Equivalencies

Mississippi uses Mississippi Medical Cannabis Equivalency Units (MMCEUs) to define limits and equivalence. One (1) MMCEU is equal to:

  • Three and one-half (3.5) grams of medical cannabis flower;
    or
  • One (1) gram of total THC in a cannabis concentrate (per SB 2748);
    or
  • One (1) gram (1,000 mg) of total THC in an infused product.

Standard retail sales taxes apply to cannabis sales.

Additionally, a 5% excise tax applies only to cannabis flower or trim at a cultivation facility’s first sale or transfer to a medical cannabis establishment. It does not apply at retail.

Cannabis waste disposal license type

There is a cannabis waste disposal license. Stores and other licensees will not be allowed to waste their own product, and instead must transfer to an appropriately permissioned license for destruction.

Potency limitsDispensaries are prohibited from selling cannabis trim or flower that has a potency of more than 30% THC or cannabis edibles, tinctures, oils or concentrates with a potency of more than 60%.
