Market Overview

On November 5, 2024, Nebraska voters approved two ballot measures: Initiative 437, the Nebraska Medical Cannabis Patient Protection Act, which protects qualifying patients who possess medical cannabis with a written recommendation from a licensed healthcare practitioner, and Initiative 438, which created the Nebraska Medical Cannabis Commission to register and license dispensaries.

Program not yet operationalNebraska's medical cannabis program is not yet live. The voter-approved laws remain subject to ongoing legal challenges, and emergency rules are in effect through July 2026 while the Nebraska Medical Cannabis Commission finalizes permanent regulations. No licensed dispensaries are operating in the state at this time, and no legal retail sales are taking place.

Patient Access

Medical cannabis is limited to registered qualifying patients who have a written recommendation from a licensed Nebraska healthcare practitioner. A regulated supply chain — cultivation, manufacturing, and licensed dispensaries — is still being established by the Commission.
