Market Overview
On November 5, 2024, Nebraska voters approved two ballot measures: Initiative 437, the Nebraska Medical Cannabis Patient Protection Act, which protects qualifying patients who possess medical cannabis with a written recommendation from a licensed healthcare practitioner, and Initiative 438, which created the Nebraska Medical Cannabis Commission to register and license dispensaries.

Patient Access
Medical cannabis is limited to registered qualifying patients who have a written recommendation from a licensed Nebraska healthcare practitioner. A regulated supply chain — cultivation, manufacturing, and licensed dispensaries — is still being established by the Commission.
Taxes
A tax structure for regulated medical cannabis sales has not yet been established, as no licensed retail sales are taking place.
Delivery
Delivery rules have not been established. With no operational dispensaries, there are no licensed delivery channels in Nebraska at this time.
