Missouri cannabis business compliance guide
Dutchie does not provide compliance advice. Merchants are responsible for their own compliance. External Dutchie compliance documentation may be updated from time to time and has been prepared for informational purposes only, is not intended to provide, and should not be relied on for, tax, legal or compliance advice. Merchants should consult their own tax, legal and compliance advisors to determine how best to operate within the cannabis industry.
Market Type
In Missouri, cannabis is regulated by the Division of Cannabis Regulations (DCR). Medical and adult-use cannabis are allowed. Missouri also allows out-of-state medical patients to purchase medical cannabis as long as they have a valid, unexpired medical marijuana registry card or its equivalent.
Metrc and Inventory
Missouri uses Metrc as their seed-to-sale state traceability system. Missouri requires that all inventory actions to be reported to the state system in real time.
Purchase Limits
Adult-use
- Consumers may purchase up to 3 ounces of dried, unprocessed marijuana or its equivalent in a single transaction
Medical
- Patients may purchase no more than 6 oz of dried unprocessed marijuana, or its equivalent, per 30 day period*
*Increased limits may be allowed with a recommendation from a physician or nurse practitioner
The medical patient allotments are tracked directly in Metrc. Dutchie POS will pull the Metrc patient allotment to determine whether a particular sale surpasses the daily or monthly patient purchasing limit.
Equivalencies

8 grams of marijuana concentrate =
800 mg of THC in infused products
Taxes
Adult-use
4.225% state sales tax (local sales tax may also apply)
Medical

Packaging Labeling
Missouri Final Packaging Labeling/Item Approval Process
DCR requires that each different final marijuana product SKU produced by each individual licensee, including the packaging, labeling, and product design, obtain pre-approval by DCR prior to being made available for sale to patients and consumers. Once an item has been approved, the licensee will receive an approval number for the marijuana product, packaging, and label design that is to be featured on the label.
Licensees submit requests for approval through Metrc via the Item Approval process. Any new items created in the “final packaging” categories will be automatically submitted for approval.
See Packaging and Labeling Guidance ->
Delivery
Retailers and transportation licensees may transport cannabis to patients and consumers.
Payment
- Delivery orders may be prepaid or payment may be received up until the point of delivery.
- If not receiving pre-payment for a delivery order, a dispensary licensee may deliver to no more than two (2) individuals at the same address on the same day
Delivery Operations
- Delivery is allowed to any address directed by the customer, as long as the address is a location allowing for the legal possession of marijuana product
- Prior to transporting cannabis, and inventory manifest for that trip must be completed and printed from Metrc and must be provided by the facility from which cannabis is being transported.
Things to Note
- Capture of Consumer Information - If a dispensary licensee receives transactions via the internet, it must ensure that the third party entity providing services for online ordering does not collect or distribute consumer, qualifying patient, or primary caregiver data for use in any way other than for the online ordering process
- Medical Barcode Scanning Requirement - As of May 31, 2023, the Division of Cannabis Regulation (DCR) is requiring that dispensaries scan the barcode located on the back of the Department-issued medical identification cards to initiate medical cannabis sales.
